1. Who these terms are between
These terms govern the use of the BahiKash cloud point-of-sale platform operated by Bhupender Kumar Verma (BahiKash OÜ incorporation in progress, see Imprint) by restaurants and other hospitality businesses ("Tenants").
End customers of the Tenant (people placing orders via a QR code) are not party to these terms; their relationship is with the Tenant, subject to the Tenant's own privacy policy and consumer-protection obligations.
2. What BahiKash provides
- A hosted tenant instance at
[subdomain].bahikash.comincluding admin login, POS terminal, customer QR ordering, kitchen display, and reporting. - Data storage in Estonia (EEA) with daily backups retained for seven days.
- Best-effort availability during the beta period (we aim for 99% uptime, not guaranteed).
- Email support during Estonian business hours.
3. What Tenants agree to
- Use the service only for lawful hospitality operations.
- Maintain a privacy policy for their own customers that complies with GDPR.
- Take responsibility for staff access: a compromised owner PIN is the Tenant's responsibility to rotate promptly.
- Not attempt to reverse-engineer, scrape, load-test, or otherwise abuse the platform.
- Not use the platform to process prohibited goods or services (illegal drugs, weapons, counterfeit goods).
- Pay any applicable subscription fees (zero during agreed beta period).
4. Data and privacy
The Tenant is the data controller for personal data of their own customers. BahiKash is the data processor acting on the Tenant's instructions. See the Data Processing Agreement for details.
BahiKash's own data practices (how we handle Tenant account information, signup telemetry, logs) are described in the Privacy Policy.
5. Pricing and billing
Beta Partners pay zero subscription fees during their agreed beta period. Post-beta, Tenants pay the tier they select on the Pricing page. Tier pricing may change with 30 days' written notice after beta ends. Card-processing fees and hardware costs charged by third parties (SumUp, Stripe, etc.) are the Tenant's responsibility.
6. Term and termination

- Either party may terminate for convenience with seven days' written notice.
- BahiKash may suspend service immediately if a Tenant violates §3 (lawful use), subject to notice and a reasonable cure period where feasible.
- On termination, BahiKash provides a full data export in CSV or JSON format within seven days and deletes Tenant data within 30 days of export confirmation.
7. Liability
During beta: liability of either party is capped at EUR 500 for any claim, and no party is liable for indirect, consequential, or lost-profit damages. This cap does not apply to wilful misconduct or breaches of data protection law.
After beta: replaced by the production SLA and liability framework, which will be published before beta ends.
8. Changes during beta
We may push changes that require a brief service interruption or a re-login with at least 24 hours' notice. We may ship breaking API changes to the admin surface during beta; we will not make breaking changes to customer-facing QR ordering without at least seven days' notice to Tenants.
9. Governing law and disputes
Estonian law applies. Disputes first attempted by good-faith conversation via support@bahikash.com, then under the jurisdiction of Harju County Court (Harju Maakohus), Tallinn.
